Affiliate program terms

Who we are

The program is run by SpotPeaks v/Nicolas van Arkens, a sole proprietorship registered in Denmark (CVR 40494537), Ringstedgade 7, st. th, 2100 København Ø, Denmark. You can reach us at hello@spotpeaks.com. The program runs on Rewardful, which records your link, the visitors and customers it brings, and your commission.

Who can join

Anyone 18 or older who publishes content about ecommerce, such as videos, posts, articles, newsletters, courses or a community, and who can receive payments by PayPal. We may decline an application or close an affiliate account, for example one set up only to collect coupon traffic.

What you earn

• 30% of every subscription payment made by a customer you referred, for as long as that customer stays subscribed. Monthly and yearly plans both count.
• Commission is worked out on what the customer actually pays for the subscription, after any discount. Taxes such as sales tax or VAT are not included.
• There is no commission on free trials, on payments that are refunded or charged back, or on your own account.
• If we ever change the rate, the change applies to new referrals only. Customers you referred before the change keep earning you the rate that applied when they first paid.

How referrals are counted

Your link carries your own code. When someone clicks it, a cookie remembers your code for 60 days. If they start a subscription within those 60 days, they count as your referral. If someone has clicked more than one affiliate’s link, our affiliate software decides which link gets the credit.

Tracking relies on that cookie. A visitor who blocks cookies, clears them or switches device may not be recorded, and we can only pay commission on referrals the software recorded.

When and how you are paid

Each commission is held for 30 days, so a refund in that time can be taken back out. After that it is paid in our next monthly payout, by PayPal, once your balance is $25 or more. Smaller balances roll over to the next month. Payouts are in US dollars. You are responsible for any tax on what you earn.

How you may promote SpotPeaks

You must:

• Say you are an affiliate wherever you share your link, for example “affiliate link” in a video description or post. US and EU advertising rules require this.
• Describe SpotPeaks accurately, and follow the rules of every platform you post on.

You must not:

• Send unsolicited emails, texts or direct messages promoting SpotPeaks, or post your link where the rules do not allow it.
• Promise income or results, for example that your audience will earn a set amount with SpotPeaks.
• Bid on SpotPeaks, or close misspellings of it, in search ads, or use the name in a domain, handle or ad account.
• Publish fake reviews, or reviews from people who have not used SpotPeaks.
• Offer discounts, coupons or cashback we have not given you.
• Present yourself as SpotPeaks, or as an official SpotPeaks account.
• Refer yourself, your own accounts, or people you pay or reward for signing up.
• Use hidden links, forced clicks, cookie stuffing or automatic redirects.

Using our name and screenshots

You may use the SpotPeaks name, logo and screenshots of the product in content about SpotPeaks. Do not alter the logo, and do not suggest that we sponsor or approve your content beyond this program.

Free access for creators

We may give creators free access to SpotPeaks to make their content. It is at our discretion, has no cash value and ends when its period ends.

Changes and ending the partnership

We may change these terms. We will email you at least 30 days before a change that lowers what you earn, and commission you have already earned is paid under the terms that applied when you earned it. You can leave the program at any time, and we can end your participation at any time. Commission stops for payments made after your participation ends. If you broke these terms, commission connected to the breach is not paid; otherwise commission you have earned is paid in the following payouts as normal.

Our relationship

You take part as an independent partner. These terms do not make you our employee, agent or representative, and you cannot make promises on our behalf.

Liability

We are not liable for losses caused by tracking failures, or by outages of our affiliate software or PayPal, beyond paying the commission that was recorded. Our total liability to you under these terms is limited to the commission paid or owed to you in the 12 months before a claim. Nothing in these terms limits liability that cannot be limited by law.

Your data

Rewardful processes your name, email address, PayPal address and referral statistics for us, to run the program. Our privacy policy explains how we handle personal data.

Law

These terms are governed by Danish law, and disputes go to the Danish courts.
