Terms of Service
Last updated: July 4, 2026. These terms govern your use of SpotPeaks. By creating an account or using the service you agree to them.
1. Who we are
SpotPeaks ("SpotPeaks", "we", "us") is operated by a sole proprietorship registered in Denmark. You can reach us at hello@spotpeaks.com. These terms are a contract between you and us.
2. What SpotPeaks is (and is not)
SpotPeaks is a research and analysis tool for ecommerce. It surfaces product data, market signals, pricing calculations, AI-generated analysis and launch materials to help you make your own decisions. It is an informational tool. It is not financial, legal, or business advice, and it does not guarantee that any product, niche, store, or strategy will be profitable. Ecommerce involves real financial risk, most new stores lose money, and outcomes depend on factors outside our data and outside your control. You are solely responsible for the decisions you make and the money you spend.
Data shown in SpotPeaks is collected from public sources and third-party platforms, is provided "as is", may be incomplete, delayed, or inaccurate, and can change at any time. AI-generated content can contain errors. Always verify important numbers at the source before spending money on them.
3. Accounts
You must provide accurate information when creating an account and keep your credentials secure. You are responsible for activity under your account. You must be at least 18 years old to use SpotPeaks. One person or business per account; accounts are not transferable.
4. Plans, trial, and billing
SpotPeaks offers a paid subscription (the "Pro" plan) billed monthly in advance through our payment provider, Stripe. Current pricing is shown on our pricing section before you subscribe. We never see or store your full card details; payment is handled by Stripe.
New subscriptions start with a 14-day free trial. You will not be charged during the trial, we send a reminder before the first charge, and you can cancel at any time during the trial at no cost. After the trial, the subscription renews automatically each month until you cancel. You can cancel any time from your account settings or the billing portal; cancellation stops future renewals and your access continues until the end of the period already paid for. Except where the law requires otherwise, payments already made are not refunded.
We may change prices with at least 30 days notice by email or in the app. Price changes apply from your next renewal after the notice period; if you do not agree, cancel before the change takes effect.
5. Your 14-day right of withdrawal (EU consumers)
If you are a consumer in the EU, you have a statutory right to withdraw from a distance contract within 14 days without giving a reason. For SpotPeaks this right is straightforward in practice: the first 14 days are a free trial in which nothing is charged, so withdrawing within the withdrawal period costs you nothing. By starting your subscription you expressly request that the service begins immediately, including during the withdrawal period. If you withdraw after paid service has begun, you owe a proportional amount for the service provided up to the point you told us you were withdrawing, and the rest is refunded. To exercise the right of withdrawal, email hello@spotpeaks.com with an unequivocal statement that you withdraw from the contract.
6. Acceptable use
You may not: resell, scrape, bulk-export, or redistribute SpotPeaks data or content; share one account across multiple people or businesses; reverse engineer the service; use the service to break the law or third-party platform rules; probe, overload, or disrupt our systems; or use automated means to access the service outside features we provide for that purpose. We may rate-limit, suspend, or terminate accounts that violate these terms, abuse the service, or create risk for us or other users.
7. Content you generate and push
Some features generate content (store copy, ad text, images, launch materials) or push products to your connected store. You are responsible for reviewing anything before you publish it, for the products you choose to sell, and for complying with the laws and platform policies that apply to your store, your ads, and your market, including consumer protection, product safety, and tax rules.
8. Intellectual property
SpotPeaks, its software, design, and content are our property or licensed to us. We grant you a limited, non-exclusive, non-transferable right to use the service for your own business while your account is in good standing. Content generated for you through the app (for example launch-kit copy) is yours to use for your business. Third-party names, marks, and data referenced in the app belong to their owners.
9. Availability, changes, and termination
We aim for high availability but do not guarantee uninterrupted service. We may add, change, or remove features. We may terminate or suspend the service or your account for material breach of these terms, and you may stop using the service and cancel at any time. Sections that by their nature should survive (including disclaimers, liability limits, and governing law) survive termination.
10. Disclaimers and limitation of liability
The service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy of data, or that the service will meet your goals. To the maximum extent permitted by law, our total liability for all claims relating to the service is limited to the amount you paid us in the 12 months before the claim arose, and we are not liable for indirect or consequential losses, lost profits, lost revenue, or lost data. Nothing in these terms limits liability that cannot be limited by law, or your statutory rights as a consumer.
11. Changes to these terms
We may update these terms. For material changes we will give notice by email or in the app at least 14 days before they take effect. Continuing to use the service after the effective date means you accept the updated terms; if you do not accept them, cancel before that date.
12. Governing law and disputes
These terms are governed by Danish law. Disputes are subject to the courts of Denmark. If you are a consumer, this does not deprive you of the protection of mandatory consumer rules of your country of residence, and you may also bring complaints to your local consumer dispute body. We prefer to solve problems directly: write to hello@spotpeaks.com first and we will make a genuine effort to fix it.
